Terms of Use
Please read these terms carefully before using PayRequest. By creating an account or using this service, you agree to be bound by these terms.
1. What PayRequest Is
PayRequest is an electronic funds transfer (EFT) payment coordination platform. It enables users to create structured payment requests and share payment links that display accurate banking details — including amount, reference, and account information — to help ensure EFT payments are completed correctly.
Important: PayRequest is a coordination tool, not a payment processor. We do not move money, hold funds, or act as a bank or financial services provider. All payments are completed directly by users through their own banking applications.
2. What PayRequest Does Not Do
To be clear about the scope of this service, PayRequest does not:
- Process, collect, or facilitate the actual movement of payments
- Hold, transfer, or manage funds on behalf of any user
- Store, request, or have access to banking login credentials or OTPs
- Provide banking services, financial advice, or investment guidance
- Guarantee that any payment has been made, received, or settled
- Act as an escrow or intermediary between payers and recipients
Payment confirmation features (such as "Paid" status) are based solely on user-uploaded proof of payment and do not constitute independent verification by PayRequest.
3. Account Registration and Eligibility
To use PayRequest, you must:
- Be 18 years of age or older, or the authorised representative of a registered business entity
- Provide accurate, current, and complete registration information
- Maintain the security and confidentiality of your account credentials
- Notify us immediately of any unauthorised access to your account
- Not create multiple accounts or share your account with others
You are solely responsible for all activity that occurs under your account.
4. User Responsibilities
By using PayRequest, you agree that:
- All information you provide — including banking details — is accurate, current, and belongs to you or your authorised entity
- You are legally authorised to use the bank account details you enter on the platform
- You are responsible for independently verifying that payments have been received in your bank account
- You will not use PayRequest for unlawful, fraudulent, misleading, or deceptive purposes
- You will not impersonate another person, business, or entity
- You will not attempt to circumvent any security measures on the platform
PayRequest is not responsible for losses arising from incorrect banking details entered by users.
5. Payment Links and Requests
Payment links generated through PayRequest:
- Display payment details exactly as entered by the requesting user
- Are intended solely to assist with EFT payment coordination
- Do not guarantee that a payment will be made or successfully received
- May have locked fields (such as amount and reference) to prevent modifications after creation
- May have expiry dates set by the creating user (on eligible subscription plans)
- Become inactive once marked as paid and cannot be reused for subsequent payments
6. Proof of Payment and Payment Status
PayRequest allows payers to upload proof of payment documents. When a proof of payment is uploaded:
- The payment link is marked as "Paid" based on the uploaded document
- PayRequest does not verify, authenticate, or validate proof of payment documents
- The recipient must independently confirm receipt of funds in their bank account
- PayRequest accepts no responsibility for fraudulent or inaccurate proof of payment documents
Status indicators are informational only. Your bank statement is the only authoritative confirmation of payment receipt.
7. Subscription Plans and Fees
PayRequest offers both free and paid subscription tiers. Paid plans are billed monthly or annually as selected. By subscribing to a paid plan, you agree that:
- Subscription fees are charged in advance for the selected billing period
- Fees are non-refundable except where required by applicable law
- PayRequest reserves the right to modify pricing with reasonable prior notice
- Continued use after a price change constitutes acceptance of the new pricing
- Downgrading your plan may result in features or data becoming inaccessible
8. Email Notifications
If you enable email notifications or provide an email address for payment link delivery:
- Emails are sent based solely on the information you provide
- PayRequest is not responsible for delivery failures, spam filtering, or incorrect email addresses
- You can manage notification preferences from your account dashboard
9. Security and Data Protection
PayRequest implements industry-standard security measures to protect your data. However:
- No system is completely immune to security breaches
- You are responsible for maintaining the confidentiality of your login credentials
- PayRequest will never ask for your banking passwords, PINs, or one-time passwords (OTPs)
- If you suspect your account has been compromised, change your password immediately and contact support
10. Prohibited Conduct
The following activities are strictly prohibited on PayRequest:
- Using the platform to commit fraud, money laundering, or any other financial crime
- Creating payment links with false or misleading information
- Attempting to gain unauthorised access to other users' accounts or data
- Using automated tools, bots, or scrapers on the platform without written permission
- Circumventing plan limitations through technical means
- Uploading malicious files or proof of payment documents
Violations may result in immediate account suspension and referral to relevant authorities.
11. Limitation of Liability
To the fullest extent permitted by the laws of South Africa, PayRequest and its directors, employees, and affiliates shall not be liable for:
- Payment errors, delays, losses, or disputes between users and third parties
- Financial losses resulting from incorrect banking details or fraudulent proof of payment
- Interruptions to service, data loss, or system downtime
- Actions or omissions of third parties including banks, payers, or internet service providers
Your use of PayRequest is entirely at your own risk. The service is provided "as is" without warranties of any kind.
12. Account Suspension and Termination
PayRequest reserves the right to suspend, restrict, or permanently terminate your account if:
- You violate any provision of these Terms of Use
- We reasonably suspect fraudulent, illegal, or abusive activity
- You provide false or misleading information during registration or use
- We are required to do so by applicable law or regulatory directive
You may close your account at any time from your dashboard. Upon closure, your data will be retained as required by law and our data retention policy.
13. Modifications to These Terms
We may update these Terms of Use periodically. Significant changes will be communicated by email or via in-app notification. Continued use of PayRequest following any update constitutes your acceptance of the revised terms.
14. Governing Law and Jurisdiction
These Terms of Use are governed exclusively by the laws of the Republic of South Africa. Any disputes arising from your use of PayRequest shall be subject to the exclusive jurisdiction of the South African courts.
